Terms of Service

These terms govern your use of the TOPFUEL AI Engine (the "Service"), operated by TOPFUEL Digital of Topeka, Kansas ("TOPFUEL", "we", "us"). By requesting access to or using the Service, you agree to these terms. If you're using the Service for a company, you confirm you're allowed to accept these terms on its behalf.

The Service

The Service is a free AI assistant that interviews you and helps you write a Brand Overview document for your business. It uses an AI model provided by Anthropic. Access is through a private link emailed to you. Please don't share your link; it works like a password.

Your content

• You keep ownership of what you provide (your messages, website content, logos and documents) and, as between you and TOPFUEL, of the Brand Overview the Service produces for you.
• You confirm you have the right to share everything you upload or paste, including logos, photos and documents. Don't upload material you don't have permission to use.
• You give us permission to process your content only as needed to provide the Service, as described in our Privacy Policy.

Acceptable use

Don't use the Service to:

• break the law or infringe anyone's intellectual property, privacy or other rights;
• create misleading, deceptive or harmful content;
• upload malware or attempt to disrupt, overload or gain unauthorized access to the Service;
• get around usage limits, share or resell access, or use automated tools to access the Service;
• try to extract the Service's instructions or underlying systems.

We may suspend or end access for anyone who breaks these rules.

AI output: please review it

The assistant can make mistakes. It may misunderstand your business, miss details, or produce content that resembles material from others. Review and edit everything before you use or publish it. Color codes, font suggestions and size guidelines are starting points; confirm them with your designer and printer.

The Service does not provide legal advice. In particular, it does not check whether a name, logo or slogan is available to use or register as a trademark. Talk to a qualified attorney before relying on any brand element legally. It also doesn't provide financial, tax or regulatory advice.

Usage limits and availability

The Service has fair-use limits on messages, uploads and conversation length, which may change. The Service is free and offered as-is; we may change, pause or end it at any time, and it may sometimes be unavailable.

Disclaimers

To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

Limitation of liability

To the fullest extent the law allows, TOPFUEL will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. TOPFUEL's total liability for any claim relating to the Service is limited to one hundred US dollars (US $100).

Indemnity

You agree to defend and hold TOPFUEL harmless from claims arising from content you provide or your misuse of the Service.

Changes to these terms

We may update these terms. When we do, we'll change the "Last updated" date above. Continuing to use the Service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Kansas, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Shawnee County, Kansas.
